Please read this agreement carefully before accessing or using the information and services available through the BrighterMonday website ("Site"). By accessing or using the Site, you agree to be bound by the terms and conditions below. BrighterMonday may modify this agreement at any time, and such modifications shall be effective immediately upon posting the modified agreement on the Site. Advertiser Terms and Conditions must be accepted and adhered to by Advertisers who use BrighterMonday's services and the Site.

Copyright and trademarks

Copyright in the material and trademarks on this Site are owned by BrighterMonday Rwanda ("BrighterMonday") unless otherwise indicated, and you agree not to infringe any intellectual property rights owned by BrighterMonday Rwanda, our parent company TATC, or affiliate companies, including www.jobberman.com.

Information for personal, non-commercial use only

You agree that information contained on this Site is for personal use only and may not be sold, redistributed, or used for any commercial purpose (this includes but is not limited to the use of Advertiser contact details for unsolicited commercial correspondence). You may download material from this Site for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices.

You agree that you may not become a paid member of BrighterMonday Rwanda to access on behalf of others, modify, copy, reproduce, republish, upload, post, transmit, or distribute in any way any material from this or any other version of the Site.

You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from this or any other version of the Site including but not limited to code, images, advertising content, advertiser identities, logos, job content, product information, general content, pricing data, advertisements, advertiser details, user interface design and software. You must not use this Site for any purpose that is unlawful or prohibited by these terms of use.

You may not use data mining, robots, screen scraping, or similar data gathering and extraction tools on this Site for establishing, maintaining, advancing, or reproducing information contained on our Site on your own website or in any other publication, except with our prior written consent.

You agree that accessing membership and logged in areas of the site without permission for non-personal or commercial use constitutes trespass.

You acknowledge and agree that information published by BrighterMonday is intended to provide general information in summary form on legal and other issues.

BrighterMonday does not endorse or recommend any of the advertisers, employers, job seekers or products advertised on its Site and BrighterMonday strongly recommends that prior to entering into any agreement with any of the Advertisers on the Site, that you obtain your own independent legal, accounting, financial, customer reputation, reference, background checking or taxation advice as appropriate. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise, products and other information provided through the Site or on the Internet generally. In no event will BrighterMonday be liable to you or anyone else for any decision made or action taken by you or anyone else in reliance upon any information contained on or omitted from the Site.

No guarantees of availability

BrighterMonday gives no guarantee to you of the continued availability of any particular job or product advertised on the Site and will not be liable to you should an advertiser have filled or withdrawn a vacancy or jobseeker availability at any time prior to removal of the advertisement or resume from the Site.

Whilst BrighterMonday takes efforts to ensure that jobs or candidates advertised are genuine and that the data presented about the job or person is accurate, it gives no guarantee to you that every job or candidate description is free from errors or inaccuracies.

No guarantees or endorsements of sites or services we link to or that link to us

BrighterMonday may provide links and pointers to Internet sites maintained by third parties from its Site. Such linked sites are not under the control of BrighterMonday and BrighterMonday is not responsible for the contents (including the accuracy, legality or decency) of any linked site or any link contained in a linked site. BrighterMonday is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by BrighterMonday of the linked site. BrighterMonday is not responsible for the copyright compliance of any linked site. BrighterMonday will not be liable for any damages or loss arising in any way out of or in connection with or incidental to any information or third party service provided by any third party.

No guarantees as to the service

BrighterMonday provides no warranty to you that the services generally available through its Site will be uninterrupted or error-free or that defects in the service will be corrected. You also understand that BrighterMonday cannot and does not guarantee or warrant to you that files available for downloading through the Site or delivered via electronic mail through the Site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

Our rights to use information you send us

BrighterMonday welcomes ideas and feedback from you about all aspects of the Site. You agree that BrighterMonday may reproduce, distribute, transmit, create derivative works of, and publicly display any materials and other information (including ideas for new or improved products and services) that you submit to any public areas of the Site (such as bulletin boards, forums and newsgroups) or by email or any other form of communication to BrighterMonday. (Please read our privacy for more information as to how we deal with information you send to us.)

No guarantees as to the security of your information

While BrighterMonday takes all due care in ensuring the privacy and integrity of the information you provide, the possibility exists that this information could be unlawfully observed by a third party while in transit over the Internet or while stored on BrighterMonday systems or on BrighterMonday's Site. BrighterMonday disclaims all liability to you to the greatest extent possible pursuant to law should this occur.

Your responsibility for your password and login

To become a registered user, you must provide a password and a login name. You are entirely responsible if you do not maintain the confidentiality of your password and login name. Furthermore, you are entirely responsible for any and all activities that occur under your login name. You may change your password at any time by following instructions. You may also change your login by contacting customer service.

You agree to immediately notify BrighterMonday of any unauthorised use of your login name or any other breach of security known to you.

No misrepresentations allowed

You agree that it is a condition on your use of the BrighterMonday Website, BrighterMonday Data or Services and of any other services provided by BrighterMonday or through the Site that you will not either through any act or omission mislead or deceive others.

General provisions

If any part of this agreement is held invalid that part shall be severed from this agreement and the remainder of this agreement will continue to be valid and enforceable.

Termination of this agreement will not end those provisions that are capable of surviving the ending of this agreement.

The laws governing this agreement will be the laws in Rwanda and you irrevocably submit to the exclusive jurisdiction of its Courts.

For the purposes of this agreement the words "BrighterMonday", "BrighterMonday Limited", "We", "Our" and "Us" refer to BrighterMonday Rwanda and "Site" to materials delivered on www.brightermonday.co.rw, www.brightermonday.co.ug.

Standard Privacy Contractual Clauses (SCCs)

1. Application of Clauses

1.1 These Standard Privacy Contractual Clauses ("Clauses") apply to all processing of Personal Data between BrighterMonday (the "Data Exporter") and the Advertiser/Employer (the "Data Importer") when such data is accessed, transferred, or otherwise processed through the Site.

1.2 These Clauses are intended to provide "appropriate safeguards" for the protection of the privacy and fundamental rights and freedoms of Data Subjects (Candidates).

2. Data Processing Instructions

2.1 The Data Importer shall process Personal Data only for the purposes of evaluating candidates for specific job openings and managing the recruitment lifecycle.

2.2 Any processing of Personal Data for purposes incompatible with the original collection purpose (e.g., secondary marketing, sale of data, or database building for third parties) is strictly prohibited and constitutes a material breach of these T&Cs.

3. Security Controls & Audit Rights

3.1 Technical Measures: The Data Importer warrants that it has implemented industry-standard security measures (including encryption and access controls) to prevent unauthorised access to candidate CVs and contact information.

3.2 Audit: Upon reasonable notice, the Data Importer shall permit BrighterMonday (or an independent auditor) to verify compliance with these privacy clauses, or alternatively, provide a self-certification of compliance.

4. Sub-processing Restrictions

4.1 The Data Importer shall not disclose or "on-ward transfer" candidate data to any third-party sub-processor (such as an external background check agency or recruitment firm) unless that third party is bound by written terms no less restrictive than these Clauses.

5. International Transfers & Local Law

5.1 The Data Importer warrants that it has no reason to believe that the laws and practices in the country of its operation prevent it from fulfilling its obligations under these Clauses.

5.2 If the Data Importer receives a legally binding request by a public authority under the laws of the country of destination for disclosure of personal data transferred pursuant to these Clauses, it shall promptly notify the Data Exporter (BrighterMonday) unless prohibited by law.

6. Liability & Indemnity

6.1 The Data Importer shall be liable to the Data Subject for any material or non-material damages caused by a breach of these Clauses.

6.2 The Data Importer agrees to indemnify and hold BrighterMonday harmless against any fines, legal fees, or damages resulting from the Importer’s failure to adhere to the Data Protection Act or these SCCs.

Data Subject Rights

1. Rights of the Data Subject

In accordance with the Data Protection Act, every individual whose personal data is processed via the Site (the "Data Subject") has the following rights, which BrighterMonday and the Advertiser agree to uphold:

1.1 Right to be Informed: The right to be informed of the use to which their personal data is to be put.

1.2 Right of Access: The right to access their personal data in the custody of BrighterMonday or the Advertiser and to receive a copy of that data.

1.3 Right to Rectification: The right to request the correction of false, misleading, or inaccurate personal data.

1.4 Right to Erasure: The right to request the deletion of false or misleading data about them, or data that is no longer necessary for the purpose for which it was collected.

1.5 Right to Object: The right to object to the processing of all or part of their personal data, including the right to opt out of direct marketing.

1.6 Right to Data Portability: The right to receive personal data in a structured, commonly used, and machine-readable format and have it transmitted to another data controller.

1.7 Right against Automated Decision-Making: The right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them.

2. Exercise of Rights

2.1 Data Subjects may exercise these rights by contacting the BrighterMonday Data Protection Officer at privacy@brightermonday.co.rw.

2.2 Where a request relates to data held by an Advertiser (e.g., a downloaded CV), BrighterMonday will forward the request to the Advertiser, who must comply within seven (7) days of receipt.

Cooperation with Regulators and Data Subjects

1. Assistance in Regulatory Compliance

1.1 Regulatory Inquiries: The Advertiser shall provide all necessary assistance and information to BrighterMonday to enable it to comply with any inquiries, audits, or investigations by the National Cyber Security Authority (NCSA) or any other competent regulatory authority.

1.2 Timely Response: If BrighterMonday receives a legal request or a "Notice to Provide Information" from a regulator regarding data processed by the Advertiser, the Advertiser must provide the requested records or evidence of compliance within forty-eight (48) hours of BrighterMonday's request.

1.3 Legal Orders: The Advertiser shall cooperate with BrighterMonday in responding to any court order, subpoena, or warrant that requires the disclosure of data or an explanation of processing activities related to the Site.

2. Support for Data Subject Requests (DSRs)

2.1 Mandatory Cooperation: While BrighterMonday facilitates the primary interface for candidate rights, the Advertiser is legally obligated to support BMR in fulfilling requests for access, correction, or deletion of personal data that has been transferred to the Advertiser's own systems.

2.2 Evidence of Deletion: Upon request by BrighterMonday (following a candidate's "Right to be Forgotten" request), the Advertiser must provide written confirmation that all copies of the specific candidate's Personal Data have been permanently deleted from their internal databases, emails, and physical files.

2.3 No-Cost Cooperation: The Advertiser shall provide this assistance to BrighterMonday at no cost, recognising that this is a shared legal obligation under the Act.

3. Breach Reporting to the Regulator

3.1 Joint Responsibility: If a data breach occurs in the Advertiser's environment involving data sourced from BrighterMonday, the Advertiser acknowledges that BrighterMonday may be required to disclose the Advertiser's identity and the nature of the Advertiser's security failure to the Regulator.

3.2 Indemnity for Non-Cooperation: The Advertiser agrees to indemnify BrighterMonday for any administrative fines or legal costs that BrighterMonday incurs as a result of the Advertiser's failure to provide the cooperation described in this section.

Pro Recruit Terms and Conditions (Coming Soon)

  1. Pro-recruit shall commence when all pre-conditions of the services are satisfactorily completed.
    (Full payment made, detailed job description and requirements provided including salary and job location) This product is for Mid Level and Entry Level roles.

  2. BrighterMonday shall provide 3- 5 suitable candidates to the hiring company. Candidates will not be thoroughly interviewed but rather their experiences and qualifications will be confirmed through a telephone call and be notified of the company their CVS will be sent to.

  3. Candidates must be given at least 48 hours prior notice to any interview keeping BrighterMonday recruitment team in the notice of dates set for interviews.

  4. BrighterMonday shall not be responsible if candidates are not given 48 hours’ notice and do not show up for the interview.

  5. BrighterMonday shall only replace candidates if condition 3 is met. 

  6. Once a candidate (s) is or is hired, BrighterMonday will only replace candidate(s) within a month the candidate leaves based on reason not from the hiring company.

  7. A replacement of a candidate who has worked more than a month or a candidate who has been dismissed from the company due to personal reasons will only be replaced by BrighterMonday at a service cost/charge.

  8. The hiring company(employer) is responsible for all background checks and references of candidates. BrighterMonday shall not be held responsible for any theft by a candidate if the hiring company fails to do this.

  9. Background checks can be conducted by BrighterMonday and handed over to the hiring company(employer) at an extra cost but the responsibility of the candidate depends solely on the employer.

  10. A pro recruit bought will be valid for no longer than 12 months from the date of proof of purchase.
